President Ted?

Ted Cruz running for President in 2016? The very notion of it sounds like an April Fools Joke gone horribly awry. The buzz has been going through the digital world, Political pundits (mainly of the Right-Wing variety) Have been pushing this notion of the Freshman Senator from Texas (and Certified Tea-Party Maniac) to actually throwing down the proverbial gauntlet and entering the battle for the Presidency. This does not sound out of the ordinary after all why would this be buzz worthy just another Tea Maniac trying to get into the White House. However Ted is a different case, see the thing with Ted is that this man who aspires to be President was actually born in Calgary Canada. Now it is a well know fact that Canada is an independent country to the north of (sorry Fox News it is not the 51st State). This could prove to be a bit of a challenge for Ted or will it? Can Ted actually throw his hat in the ring despite his birth in a foreign land?

The Constitutional requirements for the presidency are simple at first glance

 No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States”



Yes the requirements are simple 35 or older, a resident for 14 years and a natural born citizen. The term natural born citizen, has in fact been the source of many a legal argument. While the Supreme Court has never ultimately ruled on the question directly, there have been cases which have dabbled or spoken a little about the nature of what is a natural born citizen. Even among legal scholars there is often disagreement as to what it means to be a natural born citizen. Apparently being a natural born citizen would mean that a child who is born abroad but has parents that are American Citizens may be eligible for the Presidency. This has come up because the rising “fame” of Ted Cruz . Because his mother was born in the United States, despite his Canadian birth Ted Cruz according to Conservatives should be allowed to run for office. Yet while Citizenship is part of the equation because of the status of his parents Ted Cruz was not born in the United States and while he may be a Citizen he may not meet requirements. The truth is this question remains untested, the bad news is that to make the boy wonder president the overtly conservative Supreme Court may change the meaning of “natural born “ (much like they changed the meaning of the 2nd Amendment).


The buzz around Cruz’s eligibility brings to light a neat hypocrisy. Conservatives around the Country feel that Cruz should run no questions asked. They continually cite his American born mother as the reason for this. This is interesting because by following this rationale and line of thinking the whole birther movement itself (yes that Obama conspiracy), pretty much becomes a moot point!

See let’s say for example that Obama was indeed born in Kenya, well let’s ponder this for a moment, his mother like Ted Cruz’s mother was born in the United States. So if we were to apply the Ted Cruz exception, Barack Obama even if born in Kenya would in essence still be eligible for the presidency because of the citizenship status of his mother. This is pretty piece of hypocrisy considering that Ted Cruz supporters are all drum roll… “Birthers”. So how do they explain it that it is ok for their man to be eligible yet they harangued and questioned an American born president. (do you think maybe skin color played a role?)

So is Ted Cruz able to be President. The Constitution if read literally simply states no. A natural born citizen implies birth on American soil. There is no way logically that a Canadian born individual be a natural born Citizen. Ultimately though as with law in the United States they want to find a shade of gray so that Cruz can try and gain the presidency (and pretty much destroy the Country). It is is ironic that exceptions are always made for Conservatives the fact of the matter is a Progressive individual in Ted Cruz’s situation would be immediately denied and the natural born citizen clause would be interpreted the way that is mean to be interpreted without any questions ever being asked.So bottom line if logic and reason prevail there will be no President Ted in 2016 or ever
